1. Professional Services Offered

AFU Docs provides professional academic, educational, documentation, legal documentation support, research, consultancy, courier coordination, and related administrative services. Our services include, but are not limited to, the categories described below.

(a) Academic and Educational Services

  • Academic counselling and consultation;
  • University, college, and scholarship application assistance;
  • Admission guidance and documentation support;
  • Statement of Purpose (SOP), Motivation Letter, and Personal Statement preparation and review;
  • Curriculum Vitae (CV), resume, and cover letter preparation and review;
  • Educational document processing assistance;
  • Academic document editing, formatting, proofreading, and quality review;
  • Other academic and educational support services.

(b) Document Processing and Credential Evaluation Services

  • Educational document procurement and verification assistance;
  • Academic transcript, certificate, provisional certificate, migration certificate, transcript verification, and related educational document processing;
  • Credential Evaluation and Educational Credential Assessment (ECA) support;
  • Document authentication, legalization, and attestation assistance;
  • Visa Application Centre (VFS) documentation support;
  • Visa-related document preparation and application assistance;
  • Translation assistance;
  • Courier and document logistics coordination;
  • Other document processing and credential evaluation services.

(c) Legal Documentation Support Services

AFU Docs assists clients in obtaining, preparing, coordinating, and processing lawful supporting documents required for academic admissions, employment, immigration, credential evaluation, professional licensing, visa applications, and other official purposes. AFU Docs does not provide legal representation or regulated legal advice unless expressly stated through a qualified professional.

  • Property valuation reports;
  • Chartered Accountant (CA) reports;
  • Income verification documents and annual income certificates;
  • Land ownership and land lease documents;
  • House rent agreements and tenancy-related documents;
  • Affidavits and declarations;
  • Apostille, legalization, or attestation assistance where applicable;
  • Translation of official documents;
  • Supporting documentation required by educational institutions, government authorities, embassies, credential evaluation agencies, professional licensing authorities, or other competent authorities;
  • Other lawful documentation relevant to the client’s requested service.

(d) Thesis, Research, Academic Writing, and Publication Support Services

  • Thesis and dissertation preparation support;
  • Research proposal development;
  • Research methodology consultation;
  • Literature review assistance;
  • Academic assignment guidance, research assistance, editing, formatting, and presentation support for national and international educational institutions;
  • Data collection, field survey planning and implementation, recruitment and coordination of qualified enumerators, surveyors, supervisors, and other field personnel;
  • Digital questionnaire design and administration, including KoBoToolbox, mWater, ODK, SurveyCTO, REDCap, Qualtrics, and other electronic data collection platforms;
  • Field monitoring, data quality assurance, and survey management support;
  • Data entry, data cleaning, coding, database preparation, and data management;
  • Statistical data analysis using IBM SPSS Statistics, R, RStudio, Stata, Microsoft Excel, Python, and other statistical or analytical software;
  • Data interpretation, visualization, and research reporting;
  • Thesis formatting, citation, reference management, and manuscript formatting;
  • Plagiarism screening, originality assessment, and similarity report review;
  • Language editing, proofreading, and quality review;
  • Preparation of research presentations, seminar presentations, proposal defense presentations, thesis viva presentations, conference presentations, and other academic presentations;
  • Thesis-to-article conversion and manuscript preparation services;
  • Other research, academic writing, publication, and presentation support services.

(e) Coordination with Third-Party Organizations

To facilitate the services requested by clients, AFU Docs may coordinate with or provide assistance relating to:

  • Universities, colleges, schools, and educational institutions in Nepal and internationally;
  • The National Examination Board (NEB);
  • The Council for Technical Education and Vocational Training (CTEVT);
  • The Ministry of Education, Science and Technology (MoEST);
  • The Ministry of Foreign Affairs (MoFA);
  • Embassies and consulates;
  • Educational Credential Assessment (ECA) agencies;
  • Visa Application Centres (VFS);
  • Professional licensing authorities;
  • Examination boards;
  • Government authorities;
  • Courier service providers;
  • Financial institutions, where required for the requested service;
  • Other public or private organizations relevant to the services requested by the client.

The professional services described above are illustrative and not exhaustive. AFU Docs may introduce, modify, expand, suspend, or discontinue any service at its discretion and in accordance with applicable law. Nothing in these Terms shall be construed as creating an obligation on AFU Docs to provide any specific service in every circumstance, nor as guaranteeing the availability, outcome, approval, or completion of any requested service.

2. Definitions

For the purposes of these Terms of Service, unless the context otherwise requires, the following terms shall have the meanings assigned to them below:

2.1 AFU Docs

"AFU Docs," "we," "our," or "us" means AFU Docs, including its owners, directors, officers, employees, representatives, consultants, authorized agents, affiliates, successors, and assigns, as applicable.

2.2 Client

"Client," "customer," "user," or "you" means any individual, organization, institution, company, partnership, government entity, or other legal person that accesses, requests, purchases, or uses any service provided by AFU Docs.

2.3 Services

"Services" means any professional, academic, educational, research, documentation, consultancy, credential evaluation, legal documentation support, translation, editing, formatting, visa documentation assistance, courier coordination, or any other service provided by AFU Docs through its official communication channels.

2.4 Website

"Website" means the official AFU Docs website, currently accessible at https://afudocs.com, together with any associated webpages, portals, subdomains, or future official websites operated by AFU Docs.

2.5 Third-Party Organization

"Third-Party Organization" means any organization or entity independent of AFU Docs with which AFU Docs may coordinate or interact while providing services, including universities, colleges, schools, educational boards, credential evaluation agencies, government authorities, ministries, embassies, consulates, Visa Application Centres (VFS), professional licensing authorities, examination boards, courier companies, financial institutions, or other public or private organizations.

2.6 Documents

"Documents" means any academic, educational, professional, legal, financial, administrative, research, immigration, or other records, certificates, reports, transcripts, forms, applications, identification documents, supporting evidence, or related materials submitted by, obtained for, or prepared on behalf of the Client.

2.7 Business Day

"Business Day" means any day on which AFU Docs is ordinarily available to conduct business, excluding any day where services are interrupted due to public holidays, government restrictions, force majeure events, or other circumstances beyond the reasonable control of AFU Docs.

2.8 Fees

"Fees" means all professional service fees, administrative charges, consultation fees, third-party charges collected on behalf of other organizations, courier costs, payment processing charges, taxes, duties, and any other amounts payable by the Client in connection with the requested services.

2.9 Policies

"Policies" means the Refund Policy, Privacy Policy, Cookie Policy (if applicable), and any other policies, guidelines, notices, or procedures published by AFU Docs from time to time.

2.10 Agreement

"Agreement" means these Terms of Service together with the Refund Policy, Privacy Policy, any applicable service agreement, quotation, invoice, consent form, order confirmation, and any other documents expressly incorporated by reference.

2.11 Official Communication Channels

"Official Communication Channels" means the AFU Docs website, official email addresses, telephone numbers, social media accounts, messaging platforms, office premises, and any other communication channels officially designated by AFU Docs.

2.12 Applicable Law

"Applicable Law" means all laws, regulations, rules, governmental directives, judicial decisions, and regulatory requirements applicable to AFU Docs and the services provided under these Terms.

3. Acceptance of the Terms

These Terms of Service ("Terms") constitute a legally binding agreement between AFU Docs and the Client governing access to and use of the website, products, and professional services offered by AFU Docs.

By accessing or using the AFU Docs website, contacting AFU Docs through any official communication channel, requesting information, submitting documents, obtaining a quotation, making a payment, placing an order, accepting a proposal, or otherwise requesting, purchasing, or using any service provided by AFU Docs, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms, together with the Privacy Policy, Refund Policy, and any other applicable policies, guidelines, or agreements published or issued by AFU Docs.

The Client represents and warrants that they possess the legal capacity and authority to enter into this Agreement. Where the Client acts on behalf of another individual, organization, institution, or legal entity, the Client represents and warrants that they are duly authorized to act on behalf of such person or entity and to bind them to these Terms.

If the Client does not agree with any provision of these Terms, the Client must immediately discontinue access to the AFU Docs website and refrain from requesting, purchasing, or using any services provided by AFU Docs.

AFU Docs reserves the right to refuse, suspend, or discontinue the provision of any service where a Client does not accept these Terms or otherwise fails to comply with their obligations under this Agreement.

These Terms shall remain effective throughout the period during which the Client accesses the website, communicates with AFU Docs, or receives any service from AFU Docs, unless terminated or superseded in accordance with these Terms.

4. Eligibility to Use Our Services

To access or use the services provided by AFU Docs, the Client must have the legal capacity to enter into a binding agreement under the applicable laws of their jurisdiction. By requesting, purchasing, or using any service, the Client represents and warrants that they satisfy this requirement.

Where a Client is under the age of majority or otherwise lacks legal capacity, the requested services may only be obtained through a parent, legal guardian, or another person legally authorized to act on the Client’s behalf. Such representative shall be responsible for complying with these Terms and any other applicable policies of AFU Docs.

Where a Client acts on behalf of an individual, educational institution, business entity, government body, or other organization, the Client represents and warrants that they possess the necessary authority to act on behalf of that person or entity and to bind them to these Terms.

The Client shall provide complete, accurate, current, and truthful information, documents, and instructions necessary for the proper delivery of the requested services. AFU Docs reserves the right to request additional information or documentation where reasonably necessary to verify the Client’s identity, authority, or eligibility.

AFU Docs reserves the right to refuse, suspend, or terminate services where it reasonably believes that the Client does not satisfy the eligibility requirements, has provided false or fraudulent information, lacks legal authority, or requests a service that would violate applicable law, regulatory requirements, or AFU Docs policies.

Eligibility to use AFU Docs’ services does not guarantee acceptance of a service request or successful completion of any requested service. All service requests remain subject to review, availability, applicable legal requirements, and acceptance by AFU Docs.

5. Scope of Services

AFU Docs provides professional academic, educational, research, documentation, credential evaluation, legal documentation support, consultancy, courier coordination, and related administrative services to individuals, educational institutions, organizations, and other eligible clients in accordance with these Terms.

The services offered by AFU Docs are advisory, administrative, coordinative, documentation, research, and support services designed to assist clients in completing academic, professional, immigration, credential evaluation, legal documentation, and other official processes. Unless expressly agreed in writing, AFU Docs does not act as a governmental authority, educational institution, licensing authority, embassy, credential evaluation agency, or other decision-making body.

The scope of services shall be determined by the specific service requested by the Client, the information and documentation provided by the Client, applicable legal and regulatory requirements, and any written agreement, quotation, invoice, proposal, or service confirmation issued by AFU Docs.

AFU Docs shall make reasonable professional efforts to perform the requested services with due care, skill, diligence, and professionalism. However, many services involve coordination with independent third-party organizations whose policies, procedures, processing times, decisions, and requirements are beyond the control of AFU Docs.

Accordingly, AFU Docs does not guarantee admission to any educational institution; approval of any visa, permit, licence, or immigration application; issuance, authentication, legalization, or verification of any document by a third-party organization; approval or outcome of any Educational Credential Assessment (ECA); acceptance of any application submitted to a university, government authority, embassy, employer, licensing authority, or other organization; publication of research articles or manuscripts; or any specific academic, professional, legal, financial, or immigration outcome.

The Client acknowledges that successful completion of many services depends on timely submission of accurate information and documentation, compliance with applicable laws and institutional requirements, cooperation of third-party organizations, and other factors beyond the reasonable control of AFU Docs.

Unless expressly stated otherwise in writing, AFU Docs provides professional assistance and support services only and does not provide legal representation, immigration advice, financial advice, tax advice, or any regulated professional service requiring statutory licensing or authorization.

Nothing in these Terms shall be interpreted as creating any guarantee, warranty, promise, or assurance regarding the outcome of any requested service. Any estimated processing times, timelines, or anticipated outcomes communicated by AFU Docs are provided for general guidance only and do not constitute binding commitments.

AFU Docs reserves the right to decline, suspend, modify, or discontinue any requested service where necessary to comply with applicable law, regulatory requirements, professional standards, operational considerations, or these Terms.

6. Client Responsibilities

The Client shall cooperate with AFU Docs in good faith and acknowledges that successful delivery of the requested services depends upon timely provision of accurate information, complete documentation, prompt communication, and compliance with applicable legal and institutional requirements.

6.1 Accuracy of Information

The Client shall provide complete, accurate, current, and truthful information, documents, instructions, and representations necessary for the requested services and shall promptly notify AFU Docs of any changes that may affect the services.

6.2 Authenticity of Documents

The Client represents and warrants that all documents, records, certificates, identification documents, academic credentials, financial records, legal documents, and other materials submitted to AFU Docs are genuine, accurate, lawfully obtained, and free from material alteration, forgery, or fraudulent misrepresentation. AFU Docs may refuse, suspend, or terminate services where it reasonably believes that any submitted information or documentation is false, misleading, incomplete, fraudulent, or unlawful.

6.3 Timely Submission

The Client shall submit all required documents, information, approvals, and instructions within the timelines communicated by AFU Docs or relevant third-party organizations. AFU Docs shall not be responsible for delays, additional costs, or adverse outcomes resulting from the Client’s failure to provide required information or documentation in a timely manner.

6.4 Cooperation

The Client shall cooperate with AFU Docs throughout the service process and respond promptly to requests for additional information, clarification, documentation, approvals, signatures, or other actions reasonably required for completion of the requested services.

6.5 Compliance with Applicable Laws

The Client shall use AFU Docs’ services only for lawful purposes and shall comply with all applicable laws, regulations, institutional policies, immigration requirements, academic integrity policies, and governmental requirements relevant to the requested services. The Client shall not request AFU Docs to perform any act that is unlawful, fraudulent, deceptive, unethical, or contrary to public policy.

6.6 Payments and Financial Obligations

The Client shall pay all applicable professional fees, administrative charges, third-party fees, taxes, courier charges, and any other agreed amounts in accordance with the applicable quotation, invoice, payment schedule, or written agreement issued by AFU Docs. Failure to make timely payment may result in suspension, delay, or termination of the requested services.

6.7 Review of Documents

The Client is responsible for carefully reviewing all documents, drafts, reports, applications, translations, presentations, research outputs, and other materials prepared or processed by AFU Docs before submission or use. The Client shall promptly notify AFU Docs of any errors, omissions, or requested revisions.

6.8 Communication

The Client shall maintain effective communication with AFU Docs through official communication channels and ensure that contact information provided to AFU Docs remains accurate and up to date throughout the service period.

6.9 Third-Party Requirements

Where the requested service involves third-party organizations, the Client shall comply with all applicable requirements, procedures, policies, fees, and deadlines established by such organizations.

6.10 Consequences of Non-Compliance

Failure by the Client to comply with these responsibilities may result in delays, suspension, refusal, or termination of services, additional costs, rejection of applications by third-party organizations, or other consequences for which AFU Docs shall not be liable to the extent permitted by applicable law.

7. AFU Docs Responsibilities

AFU Docs is committed to providing its professional services with integrity, competence, diligence, and professionalism. Subject to these Terms, AFU Docs shall use reasonable efforts to deliver requested services in accordance with applicable laws, professional standards, and ethical business practices.

7.1 Professional Service Delivery

AFU Docs shall exercise reasonable care, skill, and diligence in providing the requested services and shall perform such services in a professional, ethical, and timely manner, subject to the availability of required information, documentation, and cooperation from the Client and relevant third-party organizations.

7.2 Good Faith and Fair Dealing

AFU Docs shall act in good faith and deal fairly with Clients throughout the provision of services, maintaining honesty, transparency, and professionalism in its communications and business practices.

7.3 Confidentiality

Subject to applicable law and the AFU Docs Privacy Policy, AFU Docs shall take reasonable administrative, technical, and organizational measures to protect the confidentiality of the Client’s personal information and documents and shall not disclose such information except with the Client’s authorization, where necessary to provide services, where required by law, or as otherwise permitted under these Terms or the Privacy Policy.

7.4 Communication

AFU Docs shall make reasonable efforts to communicate with Clients in a timely manner regarding service requirements, document deficiencies, payment matters, significant service updates, and other information reasonably necessary for the provision of services.

7.5 Accuracy and Quality Assurance

AFU Docs shall make reasonable efforts to review documents, reports, applications, research outputs, translations, presentations, and other work products prepared by AFU Docs prior to delivery. However, the Client remains responsible for reviewing and approving all final documents before submission or use.

7.6 Compliance with Applicable Laws

AFU Docs shall conduct its business operations in accordance with applicable laws, regulations, and professional standards governing its services. Where a requested service would violate applicable law, regulatory requirements, ethical obligations, or these Terms, AFU Docs may refuse, suspend, or terminate that service.

7.7 Coordination with Third-Party Organizations

Where required, AFU Docs may coordinate with universities, educational institutions, government authorities, embassies, credential evaluation agencies, Visa Application Centres (VFS), courier service providers, and other relevant third-party organizations solely for facilitating the requested services. Such coordination shall not create any agency, partnership, employment, or representative relationship between AFU Docs and any third-party organization.

7.8 No Guarantee of Third-Party Outcomes and Commitment to Service Quality

While AFU Docs shall use reasonable professional efforts to assist Clients, AFU Docs does not guarantee the approval, acceptance, issuance, publication, verification, legalization, authentication, credential evaluation, visa issuance, admission, employment, licensing, or any other decision made by a third-party organization. Any estimated processing times, expected completion dates, or anticipated outcomes are provided for informational purposes only and do not constitute contractual guarantees. Notwithstanding the foregoing, AFU Docs is committed to delivering services solely within its control with due professional care, accuracy, quality, and diligence, subject to timely Client cooperation, required information and documentation, and absence of circumstances beyond AFU Docs’ reasonable control.

7.9 Continuous Service Improvement

AFU Docs may periodically review, improve, modify, or update its services, operational procedures, technologies, and internal processes to enhance service quality, operational efficiency, legal compliance, and the overall client experience.

8. Service Requests and Engagement

A contractual engagement between AFU Docs and the Client shall commence only after AFU Docs has accepted the Client’s service request in accordance with this Section. Submission of an inquiry, request for information, or consultation does not, by itself, create any contractual obligation on the part of AFU Docs.

8.1 Service Requests

A Client may request services through official communication channels, including the website, email, telephone, office, messaging platforms, or any other communication channel officially designated by AFU Docs. The Client shall provide sufficient information and supporting documentation to enable AFU Docs to assess the requested service.

8.2 Review of Service Requests

Upon receipt of a request, AFU Docs may review the information and documentation provided by the Client to determine the nature and scope of services, availability, estimated timeline, applicable professional fees and third-party charges, additional information required, and whether the request can be accepted under these Terms and applicable law.

8.3 Quotations, Proposals, and Invoices

Where applicable, AFU Docs may provide a quotation, proposal, service agreement, invoice, payment schedule, or written communication describing the requested services, applicable fees, estimated timelines, and relevant terms. Unless otherwise specified in writing, quotations and proposals are informational and do not constitute a binding obligation until accepted by both parties.

8.4 Acceptance of Engagement

A service engagement shall be deemed accepted when AFU Docs issues written confirmation, the Client accepts a quotation or invoice, the Client makes required payment or advance payment, AFU Docs commences work, or both parties otherwise agree in writing to proceed.

8.5 Changes to the Scope of Services

If the Client requests modifications, additional services, or changes after engagement has commenced, AFU Docs may revise the service scope, adjust fees, modify the timeline, or require a revised quotation, invoice, or written agreement before proceeding.

8.6 Right to Decline Engagement

AFU Docs may decline or refuse any request where the service is unlawful, fraudulent, unethical, outside its expertise or capacity, based on insufficient or inaccurate information, inconsistent with these Terms, or likely to expose AFU Docs to unreasonable legal, financial, operational, or reputational risk.

8.7 Commencement of Services

Unless otherwise agreed in writing, AFU Docs shall commence services after acceptance of the engagement, receipt of required information and documentation, receipt of applicable advance payment or agreed fees, and satisfaction of other conditions communicated to the Client. Delays caused by the Client may result in adjustments to estimated timelines.

9. Fees, Payments, and Billing

The Client agrees to pay all applicable fees, charges, and expenses associated with the requested services in accordance with these Terms and any quotation, invoice, payment schedule, or written agreement issued by AFU Docs.

9.1 Professional Service Fees

Professional service fees shall be determined based on the nature, complexity, scope, urgency, duration, and professional requirements of the requested services and shall be communicated through a quotation, invoice, service agreement, or other written communication.

9.2 Payment Terms

The Client shall make payment according to the payment terms communicated by AFU Docs. Depending on the service, AFU Docs may require full payment in advance, partial advance payment, stage-wise or milestone-based payments, or another mutually agreed arrangement. Services may not commence until payment conditions are satisfied.

9.3 Billing and Invoices

AFU Docs shall issue quotations, invoices, receipts, or other payment records as appropriate. The Client is responsible for reviewing billing information and promptly notifying AFU Docs of any discrepancies.

9.4 Accepted Payment Methods

AFU Docs may accept payments through bank transfer, mobile banking and digital wallets, debit or credit cards, online payment gateways, cash payments where permitted, and any other payment method approved by AFU Docs. Availability may vary depending on the Client’s location and requested service.

9.5 Taxes, Bank Charges, and Payment Processing Fees

Unless otherwise stated in writing, the Client shall be responsible for applicable taxes, government charges, bank fees, currency conversion costs, payment gateway charges, wire transfer fees, or other transaction-related expenses.

9.6 Late or Outstanding Payments

Where the Client fails to pay in accordance with agreed terms, AFU Docs may suspend or delay services, withhold delivery of completed work or documents, refuse additional work, terminate the engagement, or pursue lawful remedies for recovery of outstanding amounts.

9.7 Additional Services and Expenses

Where the Client requests additional services beyond the original scope, or unforeseen expenses arise, AFU Docs may issue a revised quotation or invoice. No additional professional charge shall be imposed without informing the Client and obtaining agreement, except where the additional payment represents mandatory third-party fees, government charges, or statutory costs beyond the control of AFU Docs.

9.8 Non-Payment

Failure to make payment shall not relieve the Client of contractual obligations under these Terms. AFU Docs reserves the right to recover unpaid fees and reasonable costs incurred in collecting overdue amounts, to the extent permitted by applicable law.

10. Third-Party Services and Fees

Many services provided by AFU Docs require coordination with or involvement of independent third-party organizations. Such organizations operate independently of AFU Docs and maintain their own rules, policies, procedures, fees, processing times, and decision-making authority.

10.1 Third-Party Organizations

Depending on the service, AFU Docs may coordinate with universities, colleges, schools, NEB, CTEVT, MoEST, MoFA, government authorities, embassies and consulates, VFS, ECA agencies, professional licensing authorities, examination boards, courier and logistics service providers, financial institutions, and other public or private organizations relevant to the requested services.

10.2 Independent Third-Party Decisions

AFU Docs does not own, operate, manage, supervise, or control any third-party organization and shall not be responsible for admission decisions, credential evaluation results, visa approvals or refusals, document authentication or verification decisions, examination results, courier delays or losses after acceptance by the courier provider, processing times, or any other decision, action, omission, or requirement of a third party.

10.3 Third-Party Fees

Third-party fees may include university application fees, transcript issuance fees, document verification fees, ECA fees, embassy or consular fees, visa processing fees, VFS charges, courier and shipping charges, government fees, statutory charges, third-party translation or legalization fees, and other charges imposed by third-party organizations. Unless stated otherwise in writing, these fees are separate from AFU Docs professional service fees.

10.4 Changes to Third-Party Fees

Third-party organizations may revise, increase, decrease, introduce, or withdraw fees, requirements, procedures, or policies at any time without prior notice to AFU Docs. The Client remains responsible for applicable revised third-party fees and updated requirements. AFU Docs shall make reasonable efforts to inform the Client of material changes after becoming aware of them.

10.5 Payments Made on Behalf of the Client

Where requested by the Client and agreed by AFU Docs, AFU Docs may facilitate payment of third-party fees on the Client’s behalf. In such cases, AFU Docs acts solely as a payment facilitator; all third-party fees remain the Client’s responsibility; proof of payment may be provided where available; and AFU Docs is not responsible for refunds, disputes, delays, or losses arising from the third party’s actions or policies.

10.6 No Liability for Third-Party Services

AFU Docs shall not be liable for any loss, delay, refusal, rejection, suspension, cancellation, error, omission, or consequence resulting from the actions, decisions, systems, policies, processing times, technical failures, or requirements of any third-party organization. Nothing in these Terms creates any agency, partnership, employment, joint venture, franchise, or representative relationship between AFU Docs and any third-party organization.

11. Intellectual Property Rights

AFU Docs respects intellectual property rights and is committed to protecting its proprietary materials, business assets, and the lawful rights of its Clients. This Section governs ownership, use, and protection of intellectual property associated with services provided by AFU Docs.

11.1 Ownership of AFU Docs Intellectual Property

Unless expressly agreed otherwise in writing, all intellectual property rights relating to the AFU Docs website, trade name, logo, trademarks, service marks, branding, designs, templates, forms, documents, software, databases, methodologies, workflows, written content, graphics, photographs, videos, marketing materials, publications, training materials, and other proprietary materials developed or owned by AFU Docs shall remain the exclusive property of AFU Docs or its licensors.

11.2 Client-Owned Materials

The Client retains ownership of original documents, personal information, academic records, research data, photographs, certificates, identification documents, and other materials provided to AFU Docs. By submitting such materials, the Client grants AFU Docs a limited, non-exclusive, non-transferable, royalty-free authorization to use, reproduce, process, edit, format, translate, store, and transmit those materials solely as reasonably necessary for providing services and complying with legal obligations.

11.3 Ownership of Work Product

Unless otherwise agreed in writing, and subject to full payment of applicable fees, the final work product specifically prepared for the Client shall be made available for lawful personal, academic, professional, or organizational use. AFU Docs retains ownership of underlying methodologies, templates, proprietary processes, internal tools, checklists, formatting standards, research frameworks, software, and know-how used in preparing the work product.

11.4 Permitted Use

The Client shall use documents, reports, research materials, presentations, translations, and other work products received from AFU Docs only for lawful purposes and in accordance with applicable laws, institutional policies, and these Terms. The Client shall not reproduce, sell, sublicense, distribute, or commercially exploit AFU Docs proprietary materials without prior written consent.

11.5 Third-Party Intellectual Property

Some services may involve materials owned by third parties, including universities, publishers, government authorities, software providers, credential evaluation agencies, or other organizations. All intellectual property rights in such third-party materials remain the property of their respective owners.

11.6 Feedback and Suggestions

Where the Client voluntarily provides comments, suggestions, recommendations, or feedback relating to AFU Docs services, website, or operations, AFU Docs may use such feedback to improve services without compensation, provided that no confidential personal information is disclosed or used beyond its intended purpose.

11.7 Intellectual Property Infringement

The Client shall not submit materials that knowingly infringe third-party intellectual property rights. Where AFU Docs reasonably believes submitted materials may violate applicable laws or third-party rights, AFU Docs may suspend or refuse services until the matter has been resolved.

12. Confidentiality and Data Protection

AFU Docs recognizes the importance of maintaining confidentiality, privacy, and security of information entrusted to it by Clients. Both AFU Docs and the Client agree to handle confidential information responsibly in accordance with these Terms, the AFU Docs Privacy Policy, and applicable laws.

12.1 Confidential Information

Confidential Information includes any non-public information disclosed by either party, including personal information, academic records, research data, business and financial information, legal documents, identification documents, project materials, reports, manuscripts, presentations, work products, login credentials where provided for an authorized purpose, and any other information reasonably understood to be confidential.

12.2 Confidentiality Obligations

AFU Docs shall exercise reasonable administrative, technical, and organizational measures to safeguard Confidential Information against unauthorized access, disclosure, alteration, loss, misuse, or destruction. Except as permitted by these Terms or required by law, AFU Docs shall not disclose Client Confidential Information without consent unless reasonably necessary for providing services, coordinating with authorized third parties, complying with legal requirements, or protecting legitimate rights and safety.

12.3 Client Responsibilities Regarding Confidentiality

The Client shall maintain the confidentiality of non-public information received from AFU Docs, including proprietary documents, methodologies, internal procedures, pricing information, business strategies, and other confidential business information, and shall not disclose or use such information for unauthorized purposes.

12.4 Data Protection

AFU Docs shall process personal information in accordance with its Privacy Policy and applicable data protection laws. The Client acknowledges that certain information and documents may need to be shared with universities, government authorities, ECA agencies, embassies, VFS, courier providers, payment processors, or other authorized third parties where reasonably necessary to provide services.

12.5 Security Measures

While AFU Docs implements reasonable safeguards, no method of electronic transmission, cloud storage, or digital communication can be guaranteed completely secure. AFU Docs does not warrant that systems, communications, or storage will be entirely free from security risks, unauthorized access, cyberattacks, malware, system failures, or technological vulnerabilities.

12.6 Retention and Disposal of Information

AFU Docs may retain records and communications as reasonably necessary to provide services, comply with legal or contractual obligations, resolve disputes, enforce these Terms, or protect legitimate interests. When no longer required, AFU Docs may securely delete, destroy, anonymize, or archive information according to applicable law and internal retention practices.

12.7 Exceptions

Confidentiality obligations do not apply to information that is or becomes publicly available without breach of these Terms, was lawfully obtained from a third party without confidentiality restrictions, was independently developed without reference to Confidential Information, or must be disclosed pursuant to law, judicial process, regulatory requirement, or lawful order of a competent authority.

13. Limitation of Liability

13.1 General Limitation

To the fullest extent permitted by applicable law, AFU Docs shall not be liable for any loss, damage, expense, delay, claim, or liability arising directly or indirectly from use of, or inability to use, its services, except to the extent that such loss or damage results from the gross negligence, willful misconduct, or fraud of AFU Docs.

13.2 No Liability for Third-Party Decisions

AFU Docs shall not be liable for any decision, action, omission, delay, refusal, rejection, cancellation, suspension, requirement, or policy of third-party organizations, including universities, government authorities, embassies, VFS, ECA agencies, professional licensing authorities, examination boards, courier providers, financial institutions, or other independent organizations.

13.3 No Guarantee of Outcomes

AFU Docs provides professional assistance, coordination, consultancy, documentation, research, and administrative support services only. It does not guarantee admission, visa or permit approval, credential evaluation results, publication outcomes, employment opportunities, academic results, scholarship or funding outcomes, issuance or verification of documents, or any other outcome dependent on third-party decisions.

13.4 Client Responsibility

AFU Docs shall not be liable for loss, delay, rejection, additional expense, or adverse consequence arising from inaccurate, incomplete, misleading, or fraudulent information provided by the Client; failure to provide documents or instructions on time; failure to review or approve documents; failure to comply with applicable laws or institutional requirements; or any act or omission of the Client or their representative.

13.5 Indirect and Consequential Losses

To the maximum extent permitted by applicable law, AFU Docs shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of income or profits, business or academic opportunities, reputation, goodwill, data, or similar economic or non-economic loss.

13.6 Maximum Liability

To the extent permitted by applicable law, the total aggregate liability of AFU Docs arising out of or relating to the requested services shall not exceed the professional service fees actually paid by the Client directly to AFU Docs for the specific service giving rise to the claim. This limitation does not include amounts paid to third-party organizations, government authorities, educational institutions, embassies, courier providers, or other independent entities.

13.7 Force Majeure

AFU Docs shall not be liable for delay, interruption, failure, or inability to perform obligations where such delay or failure results from circumstances beyond its reasonable control, including natural disasters, epidemics or pandemics, war, terrorism, civil unrest, strikes, government actions, utility or internet failures, cyberattacks, acts or omissions of third parties, or other force majeure events.

13.8 Statutory Rights

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.

14. Indemnification

The Client agrees to indemnify, defend, and hold harmless AFU Docs, its owners, directors, officers, employees, consultants, representatives, agents, affiliates, successors, and assigns from and against claims, demands, actions, proceedings, liabilities, damages, losses, judgments, penalties, fines, costs, and expenses, including reasonable legal and professional costs, arising out of or relating to the matters below.

14.1 Breach of the Terms

Any breach by the Client of these Terms, the Privacy Policy, Refund Policy, or any other applicable agreement or policy of AFU Docs.

14.2 False or Misleading Information

Any inaccurate, incomplete, misleading, fraudulent, forged, altered, or unlawful information, representation, document, or material submitted by or on behalf of the Client.

14.3 Unlawful or Improper Conduct

Any unlawful, fraudulent, deceptive, unethical, negligent, or intentional act or omission by the Client in connection with services provided by AFU Docs.

14.4 Violation of Third-Party Rights

Any allegation or claim that information, documents, materials, research data, photographs, intellectual property, or other content supplied by the Client infringes or violates third-party rights.

14.5 Misuse of AFU Docs Services

Any misuse, unauthorized use, or unlawful use of AFU Docs services, website, work products, reports, research materials, presentations, templates, or other deliverables by the Client or any person acting on the Client’s behalf.

14.6 Failure to Comply with Applicable Laws

Any failure by the Client to comply with applicable laws, regulations, governmental requirements, institutional policies, professional standards, or regulatory obligations relevant to the requested services.

14.7 Scope of Indemnification

The Client’s indemnification obligation applies only to the extent the relevant claim, loss, liability, or expense arises from the Client’s acts, omissions, negligence, misconduct, breach of these Terms, or violation of law. The Client is not required to indemnify AFU Docs for loss arising directly from gross negligence, willful misconduct, fraud, or intentional unlawful acts of AFU Docs.

14.8 Notification and Cooperation

Where reasonably practicable, AFU Docs shall promptly notify the Client of any claim for which indemnification is sought. The Client agrees to cooperate in good faith in the defense or resolution of such claim, and AFU Docs shall take reasonable steps to mitigate any loss for which indemnification is claimed.

15. Suspension and Termination of Services

AFU Docs reserves the right to suspend, refuse, or terminate any service where necessary to protect its legal rights, business interests, operational integrity, clients, employees, or to comply with applicable laws and these Terms.

15.1 Suspension of Services

AFU Docs may temporarily suspend services where the Client fails to provide required information, documents, approvals, or instructions; fails to make payment; AFU Docs reasonably suspects false or unlawful documentation; the Client breaches applicable terms or policies; continuation may violate law or ethical standards; or circumstances beyond AFU Docs’ control make service temporarily impracticable. Where reasonably practicable, AFU Docs shall notify the Client and may provide an opportunity to remedy the issue.

15.2 Termination by AFU Docs

AFU Docs may terminate the service engagement immediately or upon written notice where the Client commits a material breach of these Terms; engages in unlawful, fraudulent, abusive, threatening, or unethical conduct; repeatedly fails to comply with reasonable requests; fails to pay outstanding fees after reasonable notice; the requested service becomes unlawful, impossible, or impracticable; or continuation would expose AFU Docs to unreasonable legal, financial, operational, or reputational risk.

15.3 Termination by the Client

The Client may request termination of services at any time by written notice. Termination by the Client shall not relieve the Client of obligations to pay for services already performed, work completed up to termination, non-refundable third-party fees, expenses reasonably incurred, and other amounts payable under these Terms or the applicable agreement. Any refund request shall be governed exclusively by the AFU Docs Refund Policy.

15.4 Effect of Termination

Upon suspension or termination, AFU Docs may cease work; the Client remains responsible for outstanding fees and expenses accrued before termination; AFU Docs may withhold delivery of work products or documents until outstanding payments are received where permitted by law; and obligations concerning confidentiality, intellectual property, limitation of liability, indemnification, payment, dispute resolution, governing law, and other provisions intended to survive shall remain effective.

15.5 No Waiver of Rights

Suspension or termination shall not affect legal rights, remedies, claims, or obligations accrued prior to the date of suspension or termination. AFU Docs reserves all rights and remedies available under these Terms and applicable law.

15.6 Reinstatement of Services

Where services have been suspended rather than terminated, AFU Docs may resume services at its discretion after the Client remedies the issue, all outstanding payments are received, required information and documentation are provided, and AFU Docs determines that services can reasonably continue. Reinstatement shall not constitute a waiver of rights.

16. Governing Law and Jurisdiction

These Terms, together with the Privacy Policy, Refund Policy, and any other agreements or policies incorporated by reference, shall be governed by and construed in accordance with the laws of Nepal, without regard to conflict of law principles.

The parties shall make reasonable efforts to resolve any dispute arising out of or relating to these Terms through good-faith negotiations before commencing legal proceedings, except where immediate legal action is necessary to protect rights.

Subject to the dispute resolution provisions of these Terms, the courts of Nepal shall have exclusive jurisdiction over any dispute, claim, or proceeding arising out of or relating to these Terms, the services provided by AFU Docs, or the relationship between AFU Docs and the Client.

Where applicable law permits, the parties agree to submit to the jurisdiction of the competent courts having territorial jurisdiction over the registered or principal place of business of AFU Docs, unless otherwise required by mandatory provisions of applicable law.

Nothing in this Section shall prevent AFU Docs from seeking interim, injunctive, or equitable relief before any court or competent authority where such relief is reasonably necessary to protect its legal rights, confidential information, intellectual property, business interests, or other legitimate interests.

17. Dispute Resolution

AFU Docs values constructive communication and seeks to resolve disputes promptly, fairly, and efficiently. In the event of any dispute arising out of or relating to these Terms, the services, or the relationship between AFU Docs and the Client, the parties agree to make reasonable efforts to resolve the matter as set out below before initiating formal legal proceedings, except where immediate legal action is necessary to protect rights.

17.1 Good-Faith Negotiation

Where a dispute arises, either party shall promptly notify the other party in writing, providing reasonable details of the dispute and the relief sought. The parties shall make reasonable efforts to resolve the dispute through good-faith discussions within a reasonable period.

17.2 Mediation

If the dispute cannot be resolved through negotiation, the parties may, by mutual written agreement, refer the dispute to mediation before an independent mediator mutually acceptable to both parties. Unless otherwise agreed, mediation costs shall be shared equally, without prejudice to final allocation of costs by a court or settlement.

17.3 Legal Proceedings

Where a dispute cannot be resolved through negotiation or mediation, or where mediation is not agreed, either party may commence legal proceedings before the competent courts of Nepal in accordance with Section 16.

17.4 Continued Performance

Unless the nature of the dispute makes continued performance impossible or impracticable, both parties shall continue to perform their respective obligations during the dispute resolution process to the extent reasonably practicable.

17.5 Urgent Relief

Nothing in this Section prevents either party from seeking interim, injunctive, conservatory, or other urgent equitable relief where necessary to protect confidential information, prevent unauthorized use of intellectual property, preserve evidence, prevent irreparable harm, or protect lawful rights.

17.6 Limitation Period

To the extent permitted by applicable law, any claim arising out of or relating to these Terms shall be brought within the limitation period prescribed by the applicable laws of Nepal. Nothing in this Section shall extend or shorten any mandatory statutory limitation period.

18. Amendments to the Terms

AFU Docs reserves the right to amend, revise, modify, update, or replace these Terms at any time to reflect changes in applicable laws, regulatory requirements, business operations, professional practices, technological developments, or services provided by AFU Docs.

Where a material amendment is made, AFU Docs will make reasonable efforts to notify Clients through appropriate communication channels, which may include publication on the official website, email notifications, or other official methods. Minor editorial, administrative, formatting, or non-substantive changes may be made without prior notice.

Unless otherwise stated, amendments shall become effective on the date specified in the revised version or, where no effective date is specified, upon publication on the official AFU Docs website.

The Client is responsible for reviewing the most current version of these Terms before requesting or continuing to use AFU Docs services.

The Client’s continued access to or use of the website, communication with AFU Docs, or request for or use of services after the effective date of any amendment shall constitute acceptance of the revised Terms.

If the Client does not agree with any amendment, the Client must discontinue use of AFU Docs services. Services already commenced prior to the effective date of an amendment shall continue to be governed by the Terms in effect at the time the engagement was accepted, unless otherwise agreed in writing or required by applicable law.

Nothing in this Section limits rights or obligations under applicable law or prevents AFU Docs from making immediate amendments where necessary to comply with legal, regulatory, or judicial requirements.

19. Miscellaneous Provisions

19.1 Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, applicable quotation, invoice, service agreement, consent form, and any document expressly incorporated by reference, constitute the entire agreement between AFU Docs and the Client concerning the requested services and supersede prior or contemporaneous communications, representations, negotiations, understandings, or agreements relating to the same subject matter.

19.2 Severability

If any provision is determined to be invalid, illegal, unenforceable, or contrary to applicable law, that provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed without affecting the validity or enforceability of remaining provisions.

19.3 No Waiver

Failure or delay by AFU Docs to exercise or enforce any right, remedy, or provision shall not constitute a waiver. Any waiver shall be effective only if made expressly in writing and shall apply only to the specific matter for which it is given.

19.4 Assignment

The Client shall not assign, transfer, delegate, or dispose of rights or obligations under these Terms without prior written consent of AFU Docs. AFU Docs may assign or transfer rights and obligations to any successor, affiliate, purchaser, or entity resulting from merger, acquisition, corporate restructuring, or transfer of business, provided such assignment does not materially reduce the Client’s contractual rights.

19.5 Independent Relationship

Nothing in these Terms creates a partnership, joint venture, employment relationship, agency, franchise, fiduciary relationship, or other legal relationship between AFU Docs and the Client other than that of an independent professional service provider and its Client.

19.6 Electronic Communications and Records

The Client agrees that AFU Docs may communicate electronically through its website, email addresses, messaging platforms, or other authorized channels. Electronic communications, records, invoices, quotations, approvals, confirmations, and other documents exchanged through official channels shall have the same legal effect as paper counterparts to the extent permitted by applicable law.

19.7 Survival

Any provision that by nature or wording is intended to survive suspension, termination, or expiration shall continue in effect, including provisions relating to payment obligations, confidentiality, intellectual property, limitation of liability, indemnification, dispute resolution, governing law, and other provisions necessary to give effect to these Terms.

19.8 Interpretation

Headings are provided for convenience and shall not affect interpretation. Unless context requires otherwise, the singular includes the plural and vice versa; references to one gender include all genders; the words “including,” “includes,” and “such as” mean “including, without limitation”; and references to law include amendments, replacements, or successor legislation.

The Client further acknowledges that these Terms constitute a legally binding agreement between the Client and AFU Docs governing the use of services provided by AFU Docs.

If the Client does not agree with any provision of these Terms, the Client must refrain from accessing or using the AFU Docs website and must not request, purchase, or use any services provided by AFU Docs.

These Terms shall remain in full force and effect unless and until amended, revised, replaced, or withdrawn by AFU Docs in accordance with Section 18 or as otherwise required by applicable law.

Nothing in this Section shall limit any statutory rights or legal remedies available to either AFU Docs or the Client under applicable law.
